What is a commercial premises? Definition and characteristics

The Civil Code does not precisely define what commercial premises are. However, the definition can be found in the regulation of the Minister of Infrastructure on the technical conditions that buildings and their location should meet. According to the regulation, a commercial premises should be understood as "one room or a set of rooms, separated by permanent building partitions, which is not an apartment, a technical room or a utility room."

The previous Act on the ownership of premises, in addition to "independent residential premises", also mentions "premises for other purposes". Most often, this purpose is to conduct business activities, although non-commercial activities can also be conducted in commercial premises , and this category also includes buildings of various institutions.

Types of commercial premises

The concept of commercial premises is broad and covers real estate used in very different ways. The regulation of the Minister of Infrastructure distinguishes three main types of commercial premises that must meet different technical conditions.

1. Office, commercial and service buildings and premises . The most capacious category in which you will find such diverse commercial premises as, among others, offices and offices, shops, restaurants, as well as production halls and warehouse spaces.
2 . Institutional, cultural, sports buildings and rooms and other similar facilities.
3. Buildings and short-term accommodation facilities , e.g. hotels, hostels, guesthouses, campsites and flats and apartments intended for short-term rental.

Remember that in the case of many industries - for example catering, food, hotel or medical - commercial premises must meet additional requirements specified in separate legal acts.

Can I live in a commercial premises?

Under Polish law, commercial premises cannot be used for residential purposes . This also applies if it is properly equipped and does not require any modifications. As we have already mentioned, commercial premises can be rented for a short-term stay.

However, if you rent such a property or part of it for a long-term apartment, you may face a fine of PLN 2,000. Moreover, the use of the premises may be suspended until you formally transform it into a residential premises. Also remember that real estate tax is significantly higher for commercial premises than for residential premises.

How to buy a commercial premises and what determines the price per 1 m² of commercial premises?

If you are going to buy a commercial premises, first determine your needs and requirements. Consider in particular what location, area and room layout of the premises will be suitable for your business. Then determine your budget, preferably taking into account additional costs (e.g. taxes, notary fees, possible commissions and renovation/revitalization costs), and only then start looking for offers.

They depend especially on the location - properties located in attractive parts of large cities will be much more expensive than those in smaller towns. The price is also influenced by, among others, the availability of infrastructure in the area, the layout of the rooms and the type and origin of the commercial premises - primary or secondary market. In the latter case, the technical condition is also crucial.
