GDPR – Changes in Regulations Concerning the Protection of Your Personal Data

How We Process Personal Data

As Orange Polska S.A., under the applicable regulations, we are the controller of your personal data. This means that we are responsible for using it safely and in compliance with the law.

1. For what purpose and how long will we use your personal data?

We use your personal data for the following purposes:

Direct marketing of our own products in the field of purchase, sale, and rental of real estate.

Creating reports, analyses, and statistics for our internal needs; this includes, in particular, reporting, marketing research, planning the development of our offer and services, IT system development, and creating statistical models.

Direct marketing, as mentioned above, may be carried out using electronic communication (e.g., SMS, email) and telecommunications devices (e.g., telephone).

Your data will be used:

For the period necessary to achieve the purposes specified above, and thereafter for the period and scope required by applicable law.

To demonstrate compliance with the law in processing personal data by Orange Polska S.A., for as long as a financial penalty could potentially be imposed on Orange Polska due to non-compliance.

If you give consent for the use of your data, the content of that consent will specify the purpose for which we process it.

2. What categories of your personal data do we process?

Personal data – name and surname, registered address.

Contact details – phone number, email address, correspondence address.

Identification data – ID card number, PESEL (national identification number).

3. Who do we share your data with?

We share your data with:

a) Entities processing data on our behalf, involved in performing our activities:

Our agents, advertising agencies, and other entities mediating in real estate sales, rentals, and marketing campaigns.

Entities managing our IT systems or providing IT tools.

Subcontractors supporting us in customer service and correspondence handling.

Entities providing advisory, consulting, auditing, legal, tax, accounting, or research services on our behalf.

b) Other data controllers processing data on their own behalf:

Postal or courier service providers.

Entities cooperating with us in handling accounting, tax, or legal matters – to the extent that they become data controllers.

4. Data from other sources

We receive your data from real estate agencies with which we have signed agreements. After receiving and registering a submission from such an agency, we will inform you electronically (email) or in writing about the registration and processing of your personal data provided by the agency.

5. Your rights

You may submit a request (regarding personal data) to:

Rectify (correct) data.

Delete data processed without justification.

Restrict processing (suspend operations on data or refrain from deleting data, depending on your request).

Access data (information about the data we process and a copy of the data).

Transfer data to another controller or to yourself (within the scope defined in Article 20 GDPR).

To ensure you are authorized to submit a request, we may ask for additional information to verify your identity.

The scope of each right and the circumstances under which it can be exercised are defined by law. Which right you can exercise depends, for example, on the legal basis for our use of your data and the purpose of processing.

6. Right to object

In addition to the rights listed above, you may at any time object to the processing of your data (including profiling) for direct marketing purposes. Once we receive such a request, we are obliged to stop processing your data for this purpose.

In special situations, you may also object to the processing of your personal data (including profiling) if the basis for processing is our legitimate interest or public interest. In such cases, after reviewing your request, we will no longer process the data covered by the objection unless we demonstrate that:

There are compelling legitimate grounds for processing that override your interests, rights, and freedoms, or

The grounds are necessary for establishing, pursuing, or defending legal claims.

7. Consent

If the use of your data is not required by law or does not constitute our legitimate interest, we may ask for your consent to specific uses of your data. Such consent may, for example, allow us to share data with other entities for promotional campaigns or make automated decisions based on your data at your request.

You may withdraw your consent at any time (this will not affect the lawfulness of data use prior to withdrawal).

8. Complaint

You have the right to lodge a complaint with the President of the Personal Data Protection Office if you believe that the processing of your personal data violates the law.
