The subject of the sale is the right of perpetual usufruct of land no. 332 with an area of 159.43 ha.
The plot is located in a forest, approximately 800 meters from Route 50 Mińsk Mazowiecki-Łochów. It is largely fenced. Approximately 800 meters inside the plot is a complex of buildings. The location offers very convenient access to Warsaw in approximately 40 minutes.
The forest complex includes the following buildings and structures:
- administrative building with a usable area of 432.9 m2
- farm building with a usable area of 255 m2
- office building with a usable area of 873.7 m2
- power plant building with a usable area of 222.1 m2
- transport and communications building with a usable area of 505 m2

Access to the plot: On September 11, 2019, the District Court in Mińsk Mazowiecki entered in section III of the Land and Mortgage Register a limited property right in the form of an easement of necessary right of way with an area of 0.1908 ha on plots no. 404 and 407 in favor of each perpetual usufructuary of the real estate located in the village of Borucza, Wołomin County, designated as plot 332. Additionally, an easement of free passage and driveway was established through the neighboring plot no. 397 belonging to the Mińsk Forest District over a length of approximately 160 m.
IMPORTANT: The property is covered by UPUL (Simplified Forest Management Plan).
IMPORTANT: Orange Polska is the perpetual usufructuary of the land and the owner of the buildings; the land is owned by the State Treasury. The perpetual usufructuary, in accordance with applicable regulations, particularly the provisions of the Civil Code, does not own the trees on the land, unlike with buildings. The owner of the trees is the landowner, the State Treasury. The perpetual usufructuary has the right to collect civil benefits (e.g., land rental) or natural benefits, such as fruit from the trees (fallen fruit is the property of the perpetual usufructuary).
IMPORTANT: Proceedings are pending before the District Court of Warsaw-Praga regarding the determination of the annual fee for perpetual usufruct in connection with the Wołomin Starost's termination of the current fees as of January 1, 2023, and the proposal of significantly higher fees (previously, an appeal at the request of Orange Polska was dismissed by the National Property Tribunal).
